1. ACCEPTANCE OF TERMS
Welcome to Career Wavelength ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Career Wavelength website located at www.careerwavelength.com (the "Site") and all services, content, and features offered through the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

 
2. DESCRIPTION OF SERVICES
Career Wavelength provides mental health-informed career coaching and consulting services, including but not limited to:

-Individual Career Coaching: One-on-one coaching sessions covering career navigation, job search strategy, workplace challenges, and professional development
-Resume and Cover Letter Review: Professional feedback and guidance (review and feedback only; we do not write materials from scratch)
-Mock Interviews and Interview Preparation: Practice sessions and strategic guidance for job interviews
-Offer Negotiation Coaching: Support and strategies for compensation and benefits discussions
-Job Search Strategy Sessions: Personalized guidance for navigating career transitions
-Navigating The Waves Career Series: Group workshops and training programs on various career development topics
-Speaking Engagements and Workshops: Educational presentations for organizations and groups
-Consulting Services: Career development consulting for individuals and organizations
-Blog and Educational Content: Articles, resources, and information on career development topics

2.1 Important Service Boundaries
Career Wavelength provides career coaching and guidance services only. We do NOT provide:

-Mental health counseling, therapy, or clinical services
-Medical advice or treatment
-Legal advice
-Financial planning or investment advice
-Guaranteed job placement or employment outcomes

Our services are informed by mental health awareness but do not replace professional mental health care. If you are experiencing a mental health crisis or need clinical support, please contact a licensed mental health professional, call the 988 Suicide & Crisis Lifeline, or seek emergency services.

3. USER ACCOUNTS AND REGISTRATION

3.1 Account Creation
To access certain features of the Site, including booking appointments and purchasing services, you may need to create an account. When creating an account, you agree to:

-Provide accurate, current, and complete information
-Maintain and promptly update your account information
-Maintain the security of your account password
-Accept responsibility for all activities that occur under your account
-Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility
You must be at least 18 years old to create an account and use our services. By creating an account, you represent that you are at least 18 years of age. This Site is intended for use by individuals located in the United States only. By creating an account, you represent that you are located in the United States.

3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. You may terminate your account at any time by contacting us at [email protected].

4. BOOKING AND SCHEDULING

4.1 Appointment Booking
You may book coaching sessions, consultations, and workshops through our online booking system. All bookings are subject to availability and confirmation.

4.2 Cancellation and Rescheduling Policy

Client-Initiated Changes:
Cancellations or rescheduling requests made 24 hours or more before the scheduled appointment: Full refund or credit toward future services
-Cancellations or rescheduling requests made less than 24 hours before the scheduled appointment: Session fee is forfeited, though may be applied as a credit toward future services at Career Wavelength's sole discretion
-No-shows (failure to appear without prior notice): Session fee is forfeited with no refund or credit

Coach-Initiated Changes: In the event that Career Wavelength must cancel or reschedule an appointment, Client will be offered the choice of:

-Rescheduling to an alternative date/time
-Full refund of any prepaid fees for the affected session

4.3 Technical Requirements
You are responsible for ensuring you have the necessary technology and internet connection to participate in virtual sessions. Technical difficulties on your end do not constitute grounds for a refund or free session.

5. PAYMENT TERMS

5.1 Pricing and Fees
Current pricing for services is available on our Site and may be updated from time to time. All prices are in U.S. Dollars unless otherwise stated.

Package deals and sliding scale options may be available. Please contact us for current offerings.

5.2 Payment Methods
We accept payment via credit card, debit card, and other payment methods as indicated on the Site. All payments are processed through secure third-party payment processors.

5.3 Payment Schedule
For Individual Sessions:

Payment is due at the time of booking or prior to the scheduled session

For Workshops and Series Programs:
Payment terms will be specified for each program
Generally, full payment or deposit is due at time of registration

For Consulting Services:
Payment terms will be outlined in a separate consulting agreement

5.4 Refund Policy
Refunds are provided in accordance with our cancellation policy (Section 4.2). Once a service has been delivered, no refunds will be issued except at Career Wavelength's sole discretion in cases of extraordinary circumstances.

For package services or multi-session programs:

Unused sessions may be refunded on a pro-rata basis, minus a 10% administrative fee, if cancellation occurs before 50% of sessions are completed
No refunds will be issued after 50% of sessions have been completed

5.5 Disputed Charges
If you believe you have been incorrectly charged, you must contact us within 30 days of the charge at [email protected].

Disputed charges reported after 30 days will not be investigated or refunded. This 30-day period is a strict deadline and failure to dispute a charge within this timeframe constitutes acceptance of the charge.
 
6. INTELLECTUAL PROPERTY RIGHTS

6.1 Ownership of Site Content
All content on the Site, including but not limited to text, graphics, logos, images, audio clips, video, data compilations, software, worksheets, and the compilation thereof (collectively, "Site Content"), is the property of Career Wavelength or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Site Content for your personal, non-commercial use only. This license does not include:

-Any right to reproduce, distribute, modify, or create derivative works from Site Content
-Any right to use Site Content for commercial purposes
-Any right to frame or utilize framing techniques to enclose any Site Content
-Any right to use meta tags or any other "hidden text" utilizing our name or trademarks

6.3 Trademarks
Career Wavelength, the Career Wavelength logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Career Wavelength. You may not use such marks without our prior written permission.

6.4 Copyright on Materials Provided to Clients
All worksheets, handouts, presentations, training materials, and other resources provided to clients during coaching sessions, workshops, or through the Site remain the intellectual property of Career Wavelength and are provided for the client's personal use only.

Clients may:

-Use materials for their own personal career development
-Refer to concepts and strategies learned during coaching in their own career activities

Clients may NOT:

-Reproduce, distribute, or share materials with others
-Use materials for commercial purposes
Teach or train others using Career Wavelength materials without written permission
-Post materials on social media, websites, or other public forums

6.5 Testimonials and Feedback

Testimonials and feedback may be solicited directly by Career Wavelength. By providing a testimonial, you grant Career Wavelength permission to use, publish, and display your feedback on the Site and in marketing materials. You represent that any testimonial you provide is accurate and your own original content.
 
7. USER CONDUCT AND PROHIBITED ACTIVITIES

7.1 Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

-Violate any applicable federal, state, local, or international law or regulation
-Infringe upon or violate our intellectual property rights or the intellectual property rights of others
-Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
-Submit false or misleading information
-Upload or transmit viruses, malware, or other malicious code
-Attempt to gain unauthorized access to the Site or related systems or networks
Interfere with or disrupt the Site or servers or networks connected to the Site
-Use any robot, spider, scraper, or other automated means to access the Site
Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site

7.2 Misuse of Services
You may not use Career Wavelength's services:

-To replace mental health treatment, therapy, or clinical care
-For emergency mental health situations (please call 988 or seek emergency services)
-To obtain advice outside our scope of expertise (legal, financial, medical)
-To harass, threaten, or abuse the coach in any manner that could damage, disable, overburden, or impair our services

7.3 Consequences of Violations
Violation of these Terms may result in:

-Immediate termination of your account and access to services
-Termination of current coaching relationship with no refund
-Legal action if appropriate
 
8. PRIVACY AND CONFIDENTIALITY

8.1 Privacy Policy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

8.2 Confidentiality of Coaching Relationships
Career Wavelength maintains the confidentiality of information shared during coaching sessions, except:

-Where disclosure is required by law
-Where there is imminent risk of harm to yourself or others
-Where you provide written consent for disclosure
-Where disclosure is necessary to enforce these Terms or protect our rights

8.3 Limits of Confidentiality
While we maintain confidentiality, clients should be aware that Electronic communications (email, video calls) may not be completely secure
We cannot guarantee confidentiality if you choose to use personal (non-secure) devices or networks
Third-party payment processors and scheduling platforms may have access to limited information
 
9. DISCLAIMERS AND LIMITATION OF LIABILITY

9.1 No Warranties
THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Career Wavelength does not warrant that:

-The Site will be uninterrupted, secure, or error-free
-The results obtained from use of the Site or services will be accurate or reliable
-Any errors in the Site will be corrected
-The Site or services will meet your requirements

You expressly agree that your use of the Site and services is at your sole risk. You assume full responsibility for any decisions or actions you take based on information or services obtained through the Site.

9.2 No Guarantee of Outcomes
IMPORTANT: Career Wavelength provides career guidance and coaching services but does not guarantee specific outcomes, including but not limited to:

-Job offers or employment
-Salary increases or promotions
-Admission to educational programs
-Success in interviews or negotiations
-Career satisfaction or work-life balance improvements
-Career development is influenced by many factors beyond coaching, including market conditions, individual circumstances, employer decisions, and personal effort. Results vary based on individual situations and commitment to the process.

9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAREER WAVELENGTH, ITS OWNER, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

-Your use or inability to use the Site or services
-Any unauthorized access to or use of your personal information
-Any interruption or cessation of transmission to or from the Site
-Any bugs, viruses, or other harmful code transmitted through the Site
-Any errors or omissions in any content or services
-Any conduct or content of any third party on the Site

IN NO EVENT SHALL CAREER WAVELENGTH'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO CAREER WAVELENGTH IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9.4 Basis of the Bargain
You acknowledge that Career Wavelength has set its prices and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, and that the same form an essential basis of the bargain between you and Career Wavelength.

9.5 Mental Health Services Disclaimer


Caroline Fraissinet and Career Wavelength do NOT provide mental health counseling, psychotherapy, clinical services, or medical advice. Caroline Fraissinet is not a licensed therapist, psychologist, psychiatrist, clinical social worker, or licensed mental health professional.

Career Wavelength provides career coaching and consulting services informed by mental health awareness. Our services focus on career development, job search strategy, workplace navigation, and professional growth. While we acknowledge the intersection of mental health and career wellbeing, we do not diagnose, treat, or provide therapy for mental health conditions.

If you are experiencing a mental health crisis or need clinical mental health support, please:

-Call 988 (Suicide & Crisis Lifeline)
-Contact a licensed mental health professional
-Visit your nearest emergency room
-Call 911 if you are in immediate danger


Our services are not a substitute for professional mental health care. Clients are encouraged to work with licensed mental health professionals alongside our career coaching services when appropriate.
 
10. THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites, services, or resources. These links are provided for your convenience only. Career Wavelength has no control over the content, privacy policies, or practices of third-party websites or services and assumes no responsibility for them.

You acknowledge and agree that Career Wavelength shall not be responsible or liable for any:

-Content, accuracy, or opinions expressed on third-party websites
-Damage or loss caused by your use of any third-party content, goods, or services

We encourage you to review the terms and privacy policies of any third-party websites or services you visit.
 
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Career Wavelength, its owner Caroline Fraissinet, and their respective agents, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

-Your use of the Site or services
-Your violation of these Terms
-Your violation of any third-party rights, including intellectual property rights
-Any content you submit to the Site
-Any willful misconduct or negligence on your part

This indemnification obligation will survive termination of these Terms and your use of the Site.
 
12. DISPUTE RESOLUTION

12.1 Informal Resolution
If you have a dispute with Career Wavelength, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will make reasonable efforts to resolve the dispute within 30 days.

You agree that any claim or cause of action arising out of or related to your use of the Site or services must be filed within one (1) year after such claim or cause of action arose, regardless of any statute or law to the contrary. Any claim or cause of action not filed within this one-year period shall be permanently barred.

12.2 Mediation
If informal resolution is unsuccessful, either party may initiate mediation by providing written notice to the other party. The parties agree to participate in good faith mediation conducted by a neutral mediator mutually agreed upon by both parties. The mediation shall take place in Los Angeles, California, or via videoconference if agreed by both parties.

Each party shall bear their own costs of mediation, with mediator fees split equally between the parties.

12.3 Arbitration
If mediation does not resolve the dispute within 60 days, either party may initiate binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Arbitration Terms:

-The arbitration shall be conducted in Los Angeles, California, or via videoconference if agreed by both parties
-The arbitration shall be conducted by a single arbitrator mutually agreed upon by both parties
-The decision of the arbitrator shall be final and binding
-Each party shall bear their own attorney fees unless the arbitrator determines otherwise
-Arbitrator's fees and AAA costs shall be split equally between the parties

12.4 Class Action Waiver
YOU AND CAREER WAVELENGTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Unless both you and Career Wavelength agree otherwise, the arbitrator may not consolidate or join the claims of other persons or parties, and may not otherwise preside over any form of a representative or class proceeding.

12.5 Exceptions to Arbitration
Either party may seek injunctive relief from a court of competent jurisdiction to prevent immediate and irreparable harm without first pursuing mediation or arbitration.

12.6 Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding (other than arbitration) shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of such courts.
 
13. GENERAL PROVISIONS

13.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Career Wavelength regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.

13.2 Amendments
Career Wavelength reserves the right to modify these Terms at any time. We will notify you of material changes by:

-Posting the updated Terms on the Site with a new "Last Updated" date
-Sending an email notification to the address associated with your account (if applicable)
-Displaying a notice on the Site homepage
-Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Site.

13.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms.

13.4 Waiver
The failure of Career Wavelength to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing. A waiver of any breach or default shall not constitute a waiver of any subsequent breach or default.

13.5 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without Career Wavelength's prior written consent. Career Wavelength may assign these Terms or delegate its obligations without restriction. Any attempted assignment in violation of this section shall be void.

13.6 No Third-Party Beneficiaries
These Terms are for the benefit of Career Wavelength and you only and do not create any third-party beneficiary rights.

13.7 Force Majeure
Career Wavelength shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

13.8 Survival
The following provisions shall survive termination of these Terms: Intellectual Property Rights (Section 6), Disclaimers and Limitation of Liability (Section 9), Indemnification (Section 11), Dispute Resolution (Section 12), and this General Provisions section (Section 13).

13.9 Headings
The headings used in these Terms are for convenience only and shall not affect the interpretation of these Terms.

13.11 Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Site.

13.12 Electronic Communications
By using the Site, you consent to receive electronic communications from Career Wavelength. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

14. SPECIFIC TERMS FOR WORKSHOPS AND GROUP PROGRAMS
14.1 Registration and Enrollment
Registration for Navigating The Waves Career Series and other group programs is subject to availability. We reserve the right to cancel or reschedule programs due to insufficient enrollment or other circumstances. In such cases, participants will receive a full refund or credit toward a future program.

14.2 Group Program Refund Policy
30+ days before program start: Full refund
14-29 days before program start: 50% refund or full credit toward future program
Less than 14 days before program start: No refund; credit may be offered at Career Wavelength's discretion
After program begins: No refunds

14.3 Recording and Materials
Unless otherwise stated:

-Workshops and group programs may be recorded for participants' review only
-Recordings are for personal use and may not be shared, distributed, or posted publicly
-Workshop materials are provided for participants' personal use only and may not be reproduced or distributed
 
15. TERMS FOR BLOG AND CONTENT

15.1 Educational Content Disclaimer
Blog posts, articles, and other content on the Site are provided for general educational and informational purposes only. They do not constitute professional career advice tailored to your specific situation. You should consult with a qualified career professional regarding your individual circumstances.

15.2 No Coaching Relationship Created
Reading blog content or other materials on the Site does not create a coaching or professional relationship between you and Career Wavelength. Such relationships are created only through formal engagement and agreement for services.

16. ACCESSIBILITY
Career Wavelength is committed to ensuring digital accessibility for people of all abilities. We are continually working to improve the accessibility of our Site. 17. CALIFORNIA RESIDENTS
If you are a California resident, you may have additional rights under California Civil Code Section 1789.3. 18. ACKNOWLEDGMENT
BY USING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.

If you do not agree to these Terms, you are not authorized to use the Site and should discontinue use immediately.
